so, unemployed again

i've been workin for the past 6 weeks or so as a janitor in a factory about an hour and a half from home. my schedule was 10 hours a day monday through friday, and 8 hours on saturday and again on sunday. i developed a persistent pain in my left foot about 2 weeks ago and today it become so unbearable that i left work early and went to the hospital. turns out i have a broken foot and have been walkin on it for 2 weeks. i got fired because i left work early and am now half crippled and unemployed.

I suggest you contact any labor relations boards you can. That's extremely illegal if argued by the right person. Plan B, one of those slimy settlement attorneys. But really. That's totally fucked.

DeeboCools is right, that's really fucked up. You might be able to get some money out of this.

I mean, the schedule sounds like absolute hell. If you broke your foot the hospital can vouch for you. They have no right to fire someone for being hurt and going to a hospital.

All incidents, injuries, or accidents must be reported to your employer prior to leaving your place of employment. You cannot just walk off the job, go to the hospital, then claim work related injury.

In reading your past posts you seem like a very intelligent person. Now is the time to bury that deep.

Go to the unemployment office, make sure they know you didn't know you couldn't go to the hospital when hurt. Make sure they know you were confused and thought that's what you thought the employer wanted you to do. It was a simple mistake, it's unfair, you got hurt and needed to get help.

The long hours and pain led you to not think clearly.

If your medical report states you were hurt on the job and simply made a mistake in the process due to pain and fatigue I'm sure a labor rights attorney will be happy to help you.

If you broke your foot stumbling out of a bar and didn't notice it until a few days later, well that's different.

i didn't just walk off the job, my supervisor was well aware that i've been limpin around for 2 weeks. i told him i was leavin to go to the hospital and he said ok. i got out of the emergency room on my new crutches,called to inform work and was told they had already "released me". fuckin bullshit, but nothin i can do about it. i'll have to try to survive and keep the lights on while i heal up and then get another job.

My dad works for the Missouri Division of Workers Compensation and he hears shit like this all the time. Dickbags think they can mistreat low-pay workers because they think they won't do anything. Don't be like that.

I'm an employer. Let me tell you we go to great lengths when firing someone to make sure we do it legally and correctly as not to get sued. And even then it still happens. If I were to do to you what they did, first my job would be on the line and second we would already have the lawyers expecting an action to be filed against us.

You were granted permission to go, if they state you were fired for leaving early they are toast. Go get them. Don't cost nothing and you've got the time. The lawyers get a decent cut.

This is an important piece of info right here. Most every place I have worked states that a person can be let go for any reason within a 90 day trial period.

Also he never really did say if the foot injury was caused at work or the aformentioned drunken bar stumble. Maybe he doesn't know when it happened. Good luck.

I like Hoss, he's a good dude, and I certainly hope the best for him.
